The purchase contracts concluded through e-commerce www.luthiersclar.com between Luthiers Clar S.L.U. and the consumer shall be governed by the following General Terms and Conditions.

By clicking on the button [“Finalize purchase”] you issue a binding declaration of intent by which you accept the conclusion of the order and are obliged to pay for it. You will then receive an acknowledgement of receipt of your order, confirming the conclusion of the contract.

The contract may be formalized in Spanish.

Contracts concluded in the online store are archived. You can access the orders placed in your customer account or by sending an e-mail to info@luthiersclar.com.

The prices shown include the legally applicable Value Added Tax (VAT) and are indicated in Euros. Unless expressly stated otherwise, the prices shown do not include shipping costs.

The products offered on the website will be shipped only to [the Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla]. No shipments will be made outside the delivery zone mentioned above, unless previously arranged with the company and prices are agreed upon.

Unless otherwise indicated, the products will be delivered within a period of [24 a 72horas]. Shipments to the [Canary Islands, Ceuta and Melilla] will be delivered within [24 a 72 horas].

The product will only be shipped once payment has been received.

Prices for shipments in Spanish territory.

Purchases over 180€ will be shipped free of charge.

Purchases under 180 € will have a cost of 5 €.

Spanish territory and rest of Europe cost of 50 €.

Shipments to Europe are made through the most convenient company as agreed with the customer and have an approximate delivery time of 5 to 9 days.

The following payment methods are offered: bank transfer, credit/debit card, paypal. In the case of selecting bank transfer, you will be provided by e-mail with the details of the account to which the transfer should be made.

The risk of loss or deterioration of the goods shall pass to the consumer when he or a third party indicated by him, other than the carrier, has acquired material possession of the goods. It is important that you inspect the package at the time of delivery.  You have the right to withdraw from the products purchased within 14 calendar days without giving any reason. The withdrawal period shall expire 14 calendar days from the day you or a third party indicated by you, other than the carrier, acquired material possession of the last of such goods.

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.

In the event of withdrawal by you, we will refund to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of ordinary delivery offered by us) without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any charges as a result of the reimbursement. We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the goods, whichever condition is met first. You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal shall not apply to goods concerning:

a) The provision of services, once the service has been fully performed, when the performance has begun, with the prior express consent of the consumer and user and with the acknowledgement on his part that he is aware that, once the contract has been fully performed by the entrepreneur, he will have lost his right of withdrawal.

b) The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.

c) The supply of goods made to the specifications of the consumer and user or clearly personalized.

d) The supply of goods that may deteriorate or expire rapidly.

e) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

 f) The supply of goods that after their delivery and taking into account their nature have been inseparably mixed with other goods.

g) Contracts in which the consumer and user has specifically requested the trader to visit him for urgent repair or maintenance operations; if, during such a visit, the trader provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out the maintenance or repair operations, the right of withdrawal should apply to such additional services or goods.

h) The supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the consumer and user after delivery.

(i) Contracts entered into by means of public auctions.

j) The provision of lodging services for purposes other than housing, transportation of goods, car rental, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.

k) The supply of digital content that is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.

All products offered on the website have the legal guarantee of conformity of 2 years in accordance with the conditions established in the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
